Court of Bosnia and Herzegovina issues its decisions based on the law and evidence, not based on external pressure

The Court of Bosnia and Herzegovina always issues its decisions based on the law and the adduced evidence. The primary and basic task of the Court of BiH is to maintain the trust of the public through its impartial and lawful operation. Judicial ethics and responsibility imply that it is required that judges proceed in accordance with the laws, rules and principles of justice, as well as preserve the trust in the justice system.

In issuing its decisions the Court of BiH does not yield to any and anyone’s external influence, for any such attempt would represent an attack on the Court’s independent stature. Therefore, the Court proceeds exclusively in accordance with the provisions of the law, protecting the rule of law, the Court’s impartiality and the operations of the judiciary.

 

Criminal proceedings are related to individuals, not an office or institution. Although the circumstances in which the trial in the case of Milorad Dodik et al. was conducted were rather challenging, since the Court was exposed to considerable pressure by the public and political actors, the ultimate objective of the Court of BiH was to proceed in accordance with the law and in compliance with the principles of justice and justice system impartiality.
